When a customer does not pay: the two ways of debt collection

The extrajudicial route

The judicial route
When the out-of-court phase does not yield results, the case moves on to the judicial phase, i.e. recourse to the judicial authorities.
The judge may issue an injunction, which is an enforceable order allowing for the seizure of assets, bank accounts or wages.
This procedure is longer and more costly, but it has the advantage of being binding and, in many cases, decisive.
The most effective strategy
In practice, most recoveries begin out of court: only in the event of non-cooperation on the part of the debtor is legal action taken.
Careful and gradual management allows for the optimisation of time and costs, while protecting the rights of the creditor.
